Mais l'accord a verrouillé la concurrence et le mécanisme d'attribution des licences obligatoires "singulièrement pour les Etats africains". Cette thèse démontre que ce double verrouillage tient au fait que, dans les relations "NORD-SUD", les Etats industrialisés, propriétaires de 97% des brevets d'invention, ne considèrent plus ces derniers comme des droits de propriété "immatérielle depuis la création de l'OMC", mais comme des droits de propriété "matérielle indérogeables". Hormis la pauvreté généralisée en Afrique, ce changement de nature des brevets dans les relations NORD-SUD explique les difficultés pour les Etats africains de recourir aux importations parallèles des médicaments brevetés et d'exploiter les brevets pour combattre le sida. Cela explique aussi les difficultés de négociation et d'application des solutions adoptées à l'OMC depuis 2001.
