Nevertheless, the jurisprudence of animal law still remains in a state of infancy in Europe – in contrast to the United States, where animal law has become a very lively and innovative research area within the last decade. The present anthology proposes to close this research gap and to stimulate an academic discourse on the topic. This book raises fundamental questions of legal theory regarding the realm of justice and the concept of the dignity of animals; furthermore, it deals with current issues in various sectors of Swiss law, such as animal protection law, civil law and public law. Last but not least, this anthology offers an in-depth outlook on foreign law systems as well as international law and explores new perspectives in the field.Wie sollen wir Tiere ethisch und rechtlich behandeln? Dies ist eine der brennendsten Fragen des 21. Jahrhunderts. 'Tierrecht' ist deshalb ein äusserst vielversprechendes Forschungsgebiet. Allerdings steht die rechtswissenschaftliche Auseinandersetzung mit diesem Forschungsgegenstand in Europa noch am Anfang, im Unterschied beispielsweise zum englischsprachigen Rechtsraum, wo sich die Beschäftigung mit 'animal law' in den letzten zehn Jahren zu einem sehr lebendigen Forschungsgebiet entwickelt hat. Der vorliegende Sammelband versucht, in diese Forschungslücke vorzustossen und einen wissenschaftlichen Diskurs anzuregen. Dabei werden rechtstheoretische Fragen zur Begründung einer Gerechtigkeitsgemeinschaft und zum Begriff der Tierwürde ebenso behandelt wie aktuelle Fragen im Zusammenhang mit dem schweizerischen Tierschutzrecht, Zivilrecht und Verwaltungsrecht. Der Band enthält zudem vergleichende Ausblicke auf andere Rechtsordnungen und das internationale Recht und zeigt Perspektiven gegenwärtiger Herausforderungen auf. | |
